Proposal: This application was initially submitted in 2017 and was approved by the Planning Director; however, a subsequent appeal was filed with the Land Use Board of Appeals (LUBA), which remanded the application to the Planning Director for further review, including notice to owners of property within 500 feet of the subject property. Although the applicant later sought, and received approval of, an application for a conditional use permit, that application remains on appeal to the Oregon Court of Appeals and is not under review by the county at this time. The applicant is requesting authorization of a similar use, which requires an interpretation of the Zoning and Development Ordinance.
