Land Use Hearings

The five-member Board of County Commissioners holds legislative authority in issuing land use decisions which involve creation or revision of public policy. This includes amendments to the Clackamas County Comprehensive Plan and Zoning & Development Ordinance. The Board of County Commissioners holds public hearings prior to issuing decisions, at which time the recommendation from the Planning Commission is considered.

ZDO-270 proposes three amendments to the Figures, Maps and Tables associated with the Clackamas County Comprehensive Plan, Chapter 5, Transportation System Plan. There are no text changes to the Comprehensive Plan or the Zoning Development Ordinance proposed. The changes to these Figures, Maps and Tables are necessary to maintain consistency between the Comprehensive Plan and current county practice, but none of the changes represent a substantive policy change.

The applicant is proposing three actions: (1) A Post-Acknowledgement Comprehensive Plan Amendment (PAPA) to the Clackamas County Comprehensive Plan to designate the subject property, approximately 117.55 acres, as a Goal 5 significant mineral and aggregate resource site in Chapter III, Table III-02 of the Plan (Z0568-17-CP); (2) A zoning map amendment to apply a Mineral and Aggregate Overlay (MAO) to the subject property (Z0570-17-Z); and (3) Approval of a Mineral & Aggregate Overlay District Site Plan Review application for the proposed mining operations, if the first two requests are approved (Z0569-17-MAO).

This is a legislative text amendment to the Clackamas County Comprehensive Plan and Zoning and Development Ordinance (ZDO). The proposed Plan amendments are to Chapters 4 (Land Use) and 6 (Housing), and the proposed ZDO amendments are to Sections 202 (Definitions), 602 (Business Park, Light Industrial, and General Industrial Districts), and 1203 (Conditional Uses) . A new ZDO Section 842 (Transitional Shelter Communities) would be added.

On March 22, 2017, the Board approved amendments to the county’s marijuana-related land use regulations, except that it deferred a decision on whether to allow marijuana concentrate and extract processing in the EFU and AG/F zones to May 17, 2017. (As a result, the concentrate and extract processing amendments have been given a new file number for tracking purposes.)
