OREGON CITY, Or. -- A second man accused of using a stolen excavator to break into a bank ATM and stealing cash in June was arraigned recently on multiple charges related to the incident.

Kevin Owen Miller, 51, was arraigned in Clackamas County Circuit Court on Aug. 14. Miller was charged with Aggravated Theft in the First Degree, Criminal Conspiracy, three counts of Criminal Mischief in the First Degree, Possession of a Stolen Vehicle and three counts of Unauthorized Use of a Vehicle.

Last month Owen’s co-defendant, Matthew Evan Armour, 32, was charged with Aggravated Theft in the First Degree, Criminal Conspiracy, Criminal Mischief in the First Degree, Possession of a Stolen Vehicle and two counts of Unauthorized Use of a Vehicle.

Miller and Armour are accused of driving a stolen pickup truck to an area near the US Bank branch, stealing a Caterpillar 315 excavator from a construction site and using the excavator to demolish an ATM and access a large amount of cash.

Clackamas County Sheriff's Office deputies responding to the burglary at the bank, 11521 SE Sunnyside Road, in the early morning of June 23 found the excavator still running, abandoned near the ATM drive-through.

Miller is being held at the Multnomah County Jail on a post-prison supervision violation. Miller was indicted in Clark County, Washington in January. He is accused of committing a similar attempt to break into a bank ATM and was charged with burglary, theft, possession of a stolen vehicle and possession of a controlled substance.

Miller’s next Clackamas County Court appearance is Sept. 17. Bail in the Clackamas County case was set at $40,000.
