OREGON CITY, Or. -- One of two men accused of using a stolen excavator to break into a bank ATM and steal cash pleaded guilty Friday in Clackamas County Circuit Court to theft and other charges.

Matthew Evan Armour, 33, pleaded guilty to Aggravated Theft in the First Degree, two counts of Criminal Mischief in the First Degree and two counts of Unauthorized Use of a Motor Vehicle. He was sentenced to 55 months in prison. Other charges were dismissed as part of a plea agreement.

Clackamas County Sheriff’s deputies responded to an early morning burglary on June 23 at a U.S. Bank branch at 11521 SE Sunnyside Road.

Deputies found the excavator still running, abandoned near the ATM drive-through. The suspects used the excavator's boom arm to destroy the ATM housing and damage the bank building then fled. Investigators said $58,660 was taken.

Armour was arrested July 11 as he was leaving the parking lot of a Happy Valley apartment complex. Armour was released from prison about three months before the ATM theft.

A second man, Kevin Owen Miller, 51, was arrested July 12 and also faces charges in the ATM theft. He is being held at the Clackamas County Jail. His trial is scheduled for Oct. 10.

Miller was indicted in Clark County, Washington in January. He is accused of committing a similar attempt to break into a bank ATM and is charged with burglary, theft, possession of a stolen vehicle and possession of a controlled substance.

Deputy District Attorney Tiffany Escover prosecuted the case.
