Grand jury indicts suspects from Feb. 14 Wilsonville incident


Officers Use of Force Found Justified

A Clackamas County grand jury reviewed the officer involved use of force that occurred in Wilsonville on Feb. 14, 2023 and found that the actions of the involved deputies were justified and lawful. The grand jury proceedings were held on Friday, Feb. 24.

The actions of the suspects in this case, previously identified as Brandon Gilpin and Felisha Marie Cunningham were also presented to the grand jury. Indictments were signed against both Gilpin and Cunningham.

Gilpin is indicted on the following charges:

  • Attempted Murder
  • Unlawful use of a Weapon
  • Felon in possession of a firearm
  • Unlawful Use of a Motor Vehicle
  • Attempt to Elude a Police officer.
  • Reckless Endangering Another
  • Reckless Driving

Cunningham is indicted on the following charges:

  • Attempted Murder (2 counts)
  • Unlawful use of a Weapon (2 counts)
  • Felon in possession of a firearm
  • Unlawful Use of a Motor Vehicle

As prosecution of Gilpin and Cunningham is ongoing, the District Attorney’s Office is unable to provide additional details about the circumstances of the use of force until the criminal cases against Mr. Gilpin and Ms. Cunningham have been resolved.

Ms. Cunningham was arraigned on the indictment on March 1, 2023 and is being held without bail. Mr. Gilpin remains hospitalized. When he is released, it is expected he will be arraigned on the aforementioned charges.


The composition of a grand jury is mandated under Oregon Law and described in ORS 132.010. A grand jury is a body of seven persons drawn from the available jury pool and sworn to inquire into crimes committed in Clackamas County.

This use of force investigation and the investigation into the criminal conduct were conducted by members of the Interagency Major Crimes Team which is a consortium of state, county, and municipal police agencies in Clackamas County. This investigation was led by the Milwaukie Police Department, the Oregon State Police, and the Clackamas County District Attorney’s Office.
